WILKIN, District Judge.
The motion for production of documents under Rule 34, Rules of Civil Procedure, 28 U.S.C.A. following section 723c, filed by the defendant on July 5, 1939, is sustained, and the request for an order to permit defendant to inspect such documents is granted. The time for such production and inspection is set as March -, 1940. After careful consideration of the arguments for and against the motion, it seems to this court that the purpose or object of the motion is within the spirit and the letter of the New Rules of Civil Procedure.
