Young, J.:

The statement shows that on October 19, 1900, August C. Diestelhorst died seized in fee of certain property in the borough of Brooklyn. He left a will which was probated on March 28, 1901, which, after directing the payment of debts, etc., and bequeathing all his personal estate to Ms adopted daughter, devised all Ms real estate to her for life, and upon her death devised the same to her lawful issue.
