This is an action for the direction of the eourt relative to the administration of the estate of Joshua Measle, deceased, and the same is authorized by Sec. 10857 G-. C.

*173First in logical order is the construction to be given the will of said Joshua Measle, deceased, in view of the admitted and established facts. The pertinent facts are as follows:

Joshua Measle died October 3, 1908, leaving a will, which was duly admitted to probate and record in this county. Mary Sprow, his sister and devisee under his will, died without issue surviving her August 25, 1908.
