The Commodity Futures Trading Commission (“Commission” or “CFTC”) brought this action under the Commodity Exchange Act (“CEA”), 7 U.S.C. § 1 et seq., as amended by the Commodity Futures Modernization Act of 2000 (“CFMA”), Pub.L. No. 106-554, 114 Stat. 2763, alleging that defendants fraudulently and without authorization engaged in transactions in foreign currency futures contracts.
