RICK STRANGE, Justice.
Stephen and Elliot Kemp filed a motion for rehearing, which is denied. We withdraw our opinion and judgment dated September 16, 2010, and substitute our opinion and judgment dated December 2, 2010.
This is a legal malpractice suit. Stephen and Elliot Kemp sued Paul Jensen; John Saringer; and Wagstaff, Alvis, Stub-beman, Seamster & Longacre, L.L.P. (collectively the attorneys), alleging causes of action for negligence and breach of fiduciary duty.
