Defendant, Michael Padgett, was indicted for the murder of his estranged wife, Renee Padgett, on February 22, 1990, in violation of section 9 — 1(a)(1) of the Criminal Code of 1961 (Ill. Rev. Stat. 1989, ch. 38, par. 9 — 1(a)(1) (now codified, as amended, as 720 ILCS 5/9— 1(a)(1) (West 1992))). Following a jury trial in the circuit court of Cook County, defendant was found guilty, convicted and sentenced to 28 years’ imprisonment.
