We are asked in this case to decide whether the Voting Rights Act (“VRA”), which prohibits voting qualifications that result in the abridgment of the right to vote on account of race, can be applied to a New York State statute that disenfranchises currently incarcerated felons and parolees. Although we recognize that this is a difficult question that can ultimately be resolved only by a determination of the United States Supreme Court, we conclude that the Voting Rights Act, which is silent on the topic of state felon disenfranchisement statutes, cannot be…
