This is an original proceeding in prohibition.
In 1932, Grace M. Crouch was granted a divorce a vin-culo from petitioner, Ralph Crouch, and was given the custody of their minor child. In 1937, Ralph, upon petition and hearing in the circuit court which granted the divorce, was awarded the conditional custody of the child. Mrs. Crouch desiring to appeal from that award, the court ordered Ralph to pay the costs of the appeal, including her attorney’s fee. In the instant proceeding, the petitioner seeks to have prohibited the enforcement of those payments.
