Appeal from a judgment of the Onondaga County Court (Joseph E. Fahey, J), rendered March 29, 2001. The appeal was held by this Court by order entered March 21, 2003, the decision was reserved and the matter was remitted to the Onondaga County Court for further proceedings (303 AD2d 981 [2003]).
