Gr. "W7 Rogers died intestate ■while a citizen and resident of Livingston County, Kentucky, on the 19th day of August, 1935. He was a bachelor and lived with his maiden sister, the appellee and defendant below, Martha Rogers, on a parcel of land in Livingston county in or near the village of Joy in that county (owned jointly by the two) and containing about 7% acres, upon which there was a cheap residence building which they occupied.
