Defendant in error is a fraternal benefit association. December 29, 1894, it issued a benefit certificate to August F. Apitz in which plaintiff in error was named as beneficiary. Apitz disappeared from his home November 7, 1905, and has not since been heard from. Plaintiff in error, as beneficiary, brought an action in assumpsit in the circuit court of Winnebago county on the certificate September 23, 1913.
