The question in this case is whether petitioner-appellant, a stenographer and typist employed by the board of transportation of the city of New York, is entitled to recover an annual increment at the rate of $120 for a period between the years 1942 to 1945. He was then in the military service of the United States. He claims under section 245 of the Military Law, which provides that “ Every officer and employee of the state or of a municipal corporation or of any other political subdivision ’ ’ shall be entitled to recover the excess of his compensation as such over and above that paid to him…
