This was an action to recover' a loss alleged to have been sustained-by robbery where the plaintiff was protected by a robbery insurance policy issued, sold and delivered to him by the defendant insurance company.

The case was first tried in the city court, where oral testimony was introduced, and.after a decision was rendered in that court in favor of the plaintiff, the defendant appealed and a transcript of the evidence taken in the city court was filed in the district court.
