STATEMENT OF THE CASE
The appellant, Terrance Perry, was charged by bill of information with possession of cocaine with the intent to distribute, a violation of La. R.S. 40:967(A)(1). A defense motion to suppress evidence was based on the failure of the officer to obtain the trial judge’s signature on the search warrant. Judge Jerome Winsberg heard the motion to suppress and determined that, because he was the judge to whom the affidavit and application for search warrant was presented, he might be called as a witness in the suppression hearing.
