Appeal from Dallas District Court. — J. H. Applegate;. Judge. Action to recover the value oí stock in a corporation, which stock proved to be worthless, and which was purchased by plaintiff at the solicitation of the defendant. There ivas a trial to a jury, and a verdict and judgment for defendant. The plaintiff appeals.

In the first count, the plaintiff avers that he bought the stock in question through the solicitation of the defendant, under an oral agreement by the defendant to repurchase the from him at any time within two years, at par, with 7 per cent interest per *82annum. Under the second count, the plaintiff avers that he bought the stock in question in reliance upon certain representations made to him by the defendant, which were false.
