COFFEY, Circuit Judge.

On September 13, 1995, the defendant-appellant, Scott Fawley (“Fawley”), a former employee of the Charles Klehm & Son Nursery (“Klehm Nursery”) in Champaign, Illinois, was called before a federal grand jury and testified concerning the criminal investigation of Kit Klehm (“Klehm”), owner of the Klehm Nursery, regarding Klehm’s harboring and employment of illegal aliens. On September 28, 1995, a grand jury returned an indictment charging Fawley with one count of perjury, in violation of 18 U.S.C. § 1623.
