MEMORANDUM OPINION AND ORDER

MATTHEW F. KENNELLY, District Judge:

James Dean, Jr. has sued the City of Chicago and former Chicago police officer *701Richard Fiorito, claiming that Fiorito arrested him without probable cause and made false statements that caused him to be charged with a crime. Dean has asserted two claims against Fiorito: a Fourth Amendment claim under 42 U.S.C. § 1983 and a state law claim of malicious prosecution. Dean has also asserted two claims against the City: a claim under 745 ILCS 10/9-102 for indemnification of any liability of Fiorito, and a claim under section 1983…
