OPINION

{¶ 1} Appellant Marlene Smith was convicted of murder in the Belmont County Court of Common Pleas. The victim was 29-year-old Anthony Proviano, whose body was found in December of 1997 in a wooded area near St. Clairsville. The victim had been shot once in the chest. Although the death had originally been designated as a suicide by the county coroner, it was investigated by the police as a probable homicide. Evidence was obtained from an inmate in Pennsylvania in 1999 linking Appellant to the murder. Appellant was eventually indicted for the murder in 2004, and while in prison awaiting…
