A mobile home unoccupied by the owners, Marion *20Lyke and her husband Ward Lyke, was unlawfully removed from its lot in a trailer park and deposited in a swampy area, causing damages to the mobile home. The jury awarded compensatory damages but declined to impose punitive damages. Thereafter, the trial court trebled the compensatory damages pursuant to RPAPL 853. From this simple factual scenario we encounter three novel questions in the field of law variously known as "wrongful eviction” or "unlawful eviction”.
