Chewl’s Hospitality, Inc. and Sukhdev Chewl (collectively, “Chewl”) appeal from the judgment of the district court confirming an arbitration award in favor of Choice Hotels International, Inc. (“Choice Hotels”). Chewl argues that the arbitration award should be set aside because (1) the arbitration clause is unconscionable, (2) the contractual liquidated damages clause in the underlying contract is an unenforceable penalty, and (3) Choice Hotels cannot recover both liquidated damages and damages for trademark infringement.
