Equitable petition. Before Judge Sheppard. Liberty superior court. January 5, 1918. Mrs. A. C. Wilkes, as administratrix of the estate of J. W. Groover, brought her petition against J. J. Groover and J. C. Groover, to recover certain lands and to cancel deeds, and for other equitable relief. The plaintiff’s intestate had conveyed the land in controversy, by warranty deed, to his grandson, J. J. Groover, one of the defendants, upon the expressed consideration of natural love and affection “and the consideration of support and maintenance of the said [grantor] and his wife;” the deed containing…

(After stating the foregoing facts.)

1. The defendants in their motion for a new trial set up the contention that the court was without jurisdiction to try the question as to whether or not the sheriff’s deed to Baiford and Eaiford’s quitclaim deed to E. J. Groover should be canceled. In support of their contention they cite several decisions by' this court, in which it is ruled that both the grantor and the grantee *796are necessary parties to proceedings to cancel deeds. We do not think, however, the defendants are in position to successfully urge this contention in the motion for a new trial.…
