This was a bill in equity in favor of Isaac H. Holden against Asa Pike and Jonathan Pike, and was heard on bill, answer and proof. The parties and witnesses all lived in the State of Rhode Island. The controversy grew out of the purchase of land in the county of Aroostook in this State. On February 23, 1835, the State conveyed to Randal Whidden several lots of land in the town of Amity, amounting in the whole to about 17,500 acres, in fee simple, on condition that the grantee should pay, when payable, his four notes of hand for the sum of $2577,25, each, (which came to maturity in one, two, three and four years from their dates) and should cause twenty of the lots to be settled within five years from the time of the conveyance.
