The opinion of this court issued March 29, 1977, is hereby set aside and withdrawn. The following opinion becomes the opinion of the court.

The appellant was indicted for the first degree murder of Christine Lott. A petit jury found him guilty of murder in the second degree and fixed his punishment at fifty years imprisonment in the penitentiary.
