Presently before the court is the defendant’s motion to sever brought pursuant to Fed. R. Civ. Pro. 42(b). (Doc. No. 6).
I. FACTUAL AND PROCEDURAL BACKGROUND
This case arise from a car accident where the plaintiff was hit by another motorist. The plaintiff was covered by an insurance policy issued by the defendant. The policy had an underinsured motorist (UIM) coverage of $25,000/$50,000 stacked by two vehicles. (Doc. No. 1, Exh. 2).
