This case arises out of a standoff between James Murphy, Sr. and the Albuquerque Police Department (“APD”) that ended when a SWAT team officer shot and killed Mr. Murphy in Mr. Murphy’s home. Theresa James, as Mr. Murphy’s estate representative and custodial parent , of her and Mr. Murphy’s daughter, brought a complaint in the United States District Court for the District of New Mexico regarding Mr. Murphy’s death.
