JUDGMENT & ORDER

WEINSTEIN, Senior District Judge.

The petition for a writ of habeas corpus pursuant to section 2254 of Title 28 of the United States Code is denied. No hearing was held on the matter due to petitioner’s deportation on April 25, 2003.

I. Factual Background

On May 19, 1996, an undercover officer made a peephole purchase of crack cocaine at a basement apartment in Brooklyn. The money used to purchase the drugs had been pre-recorded and marked with a fluorescent powder. Soon thereafter, a search warrant was executed at the premises.
