This appeal, perfected by the defendant from an adverse judgment, was transferred to this court by the Supreme Court, La. Sup., 52 So.2d 753. The Board of Commissioners of the Port of New Orleans (commonly referred to as the Dock Board) proceeds under authority of the Uniform Declaratory Judgments Act, LSA-RS 13 :- 4231-46, against The Hibernia National Bank in New Orleans, as successor trustee for the bondholders under three certain mortgages of the Board, for a judicial interpretation of certain special provisions in the mortgages which secured bonds issued for funds obtained…
