Appellant Rafael Garza Martinez appeals his conviction for felony possession of marijuana. Without the benefit of an agreed punishment recommendation, Martinez pleaded guilty to a jury. The jury sentenced him to eight years confinement in the Institutional Division of the Texas Department of Criminal Justice and fined him $7,500.
