Appeal from a judgment of the Appellate Division of the Supreme Court in the second judicial department, entered March 22, 1915, affirming a judgment in favor of defendant entered upon a verdict directed by the court. This action was brought for the determination of a claim to real property under the provisions of section 1638 of the Code of Civil Procedure. The plaintiff is the owner of an estate at Great Neck on the west side of Manhasset bay.
