This matter is before the court on defendant’s motion for an order affirming the Secretary’s decision and plaintiff’s motion for summary judgment or, in the alternative, motion for judgment on the pleadings.
This is an action under Section 205(g) of the Social Security Act, 42 U.S.C. § 405(g), for judicial review of a final decision of the Secretary of Health and Human Services. Plaintiff’s applications — under Title II, 42 U.S.C. § 401 et seq., and Title XVI, 42 U.S.C. § 1381 et seq. —were initially and upon reconsideration denied. However, on…
