In an action to recover damages for personal injuries, the defendant William H. Garris appeals, as limited by his brief, from so much of an order of the Supreme Court, Kangs County (Barron, J.), dated December 19, 2001, as denied his motion pursuant to CPLR 3211 (a) (7) to dismiss the complaint insofar as asserted against him and granted that branch of the plaintiffs cross motion which was pursuant to CPLR 2201 for a temporary stay of proceedings against him.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the motion is granted, the complaint is dismissed…
