In an action to recover damages for breach of contract and defamation, the plaintiff appeals from an order of the Supreme Court, Nassau County (Martin, J.), dated September 17, 2007, which granted that branch of the motion of the defendant Mercy Medical Center which was to dismiss the complaint insofar as asserted against it pursuant to CFLR 3211 (a) (5).
Ordered that the order is affirmed, with costs.
