Following a jury trial, Arquimedes Gonzales appeals his conviction of family violence battery, 1 aggravated assault (two counts), 2 kidnapping with bodily injury, 3 and aggravated battery 4 (two counts). 5 He contends that (1) the trial court erred in refusing to merge the two aggravated battery counts, and (2) he received ineffective assistance of counsel because his trial counsel failed to request a jury charge on false imprisonment as a lesser-included offense as to the kidnapping with bodily injury charge.
