The defendant, Mack Pritchett, was charged in the court of common pleas of Tulsa county with the crime of unlawful possession of intoxicating liquor, towit: Ten pints of gin and 13 pints of ivhisky; was tried, convicted and sentenced to pay a fine of $50 and serve 30 days in the county jail. From this judgment and sentence he has appealed.
The contention for reversal of this case is based upon the fact that the court erred in refusing to sustain the motion to suppress the evidence. This motion, omitting the caption, is as follows:
