delivered the opinion of the court.

The judgment from which this appeal is taken was rendered in an action in case by appellee against appellant for causing the death of William Julius, by negligence. The amount of the judgment is $3,780. No question is raised as to the sufficiency of the declaration, or as to variance between it and the evidence. The defendant pleaded the general issue.
