Appeal by the plaintiff, Sanford E. Gee, from a judgment of the Supreme Court in favor- of the defendants, entered in the office of the clerk of the county of New York on the 21st day of May, 1901, upon the decision of the court, rendered after a trial at the New York Special Term, dismissing the complaint.

The complaint in this action alleges the making of a contract between the parties by which the plaintiff was employed as a salesman, and as compensation for services rendered he was to receive five per cent on all sales of the goods of the defendants in the State of New Jersey, the city of' New York and Long.
