This was an action of tort brought by the administratrix of the estate of Michael Brennan, to recover for his conscious suffering and death alleged to have resulted from the negligence of the defendant. At the close of the evidence the defendant moved that a verdict be ordered for the defendant. The trial judge denied the motion, and submitted ten interrogatories to the jury. The defendant duly excepted to the denial of the motion and to the submission of the interrogatories.
