OPINION

ANDERSON, Justice.

Appellant, Darrell Lee Dean, was convicted of burglary of a habitation with intent to commit theft. He raises five points of error in this appeal of his conviction. First, he argues that the trial judge violated article 30.01 of the Texas Code of Criminal Procedure by presiding over this case. His second, third, and fourth points of error challenge the trial court’s adverse ruling on a motion to suppress evidence.
