This is a declaratory judgment action wherein A. C. E. Equipment Company of Minnesota, Inc., seeks a determination that it is entitled to a building permit to construct a high-rise apartment building on its property in the city of Minneapolis.

For plaintiff to be permitted to construct a high-rise, multidwelling unit on its property, it is necessary that the property be rezoned. On May 8, 1964, the city council amended its zoning ordinance in such a way as to permit such construction. This amending ordinance was vetoed by the mayor of Minneapolis on May 15, 1964.
