The appellant, James Eunnels, was indicted at the January term of the criminal court of Phillips county,, for murder. At the September term, he was tried and found guilty of murder in the first degree. Motion for a new trial overruled, and defendant sentenced to be hung on the 13th day of December, 1872. On the 25th of November, 1872, an appeal and supersedeas was granted by this court.
