These two cases were heard together in the lower court and will be disposed of in one opinion.
In March, 1910, the appellants, who are retail merchants, purchased from the appellees, who are wholesale merchants, a quantity of Economy Fruit Jars. The sales were made through an agent of the appellees, and the contract of purchase was in writing. This writing *59among other things, contained the following provisions in large type:
