—In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Suffolk County (Jones, J.), entered *366September 9, 1999, which denied his motion pursuant to CPLR 3211 to dismiss the complaint on the ground that it is barred by the exclusivity provisions of the Workers’ Compensation Law.

Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed.
