McKENNA, District Judge.
Plaintiff Alfred J. Bianco is Plan Administrator of the Trustee’s Third Amended Plan of Reorganization (the “Plan”) of the law firm of Gaston & Snow (the “Debtor”). Defendants Carlton R. Asher, Jr. (“Asher”), Thomas I. Elkind (“Elkind”) and Donna M. Sherry (“Sherry”) are former partners in the Debt- or. On November 16, 1993, Plaintiff commenced an Adversary Proceeding (the “Proceeding”) against the Defendants, seeking recovery for the benefit of Gaston & Snow’s creditors.
