OPINION

BUSSEY, Judge:

Appellant, Higino Cat Jiminez, hereinafter referred to as defendant, was charged and tried in the District Court, Oklahoma County, Case Nos. CRM-75-979 and CRM-75-989, for the offenses of Unlawful Possession of Marihuana and of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, respectively. The defendant was convicted of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, in violation of 47 O.S.1971, § 11-902.
