DECISION AND ORDER

WILLIAM A. CLARK, Bankruptcy Judge.

This cause came before the court as an adversary proceeding to determine the dis-chargeability of certain debts owed by the debtor. The parties have filed pleadings, memoranda, and exhibits. At the eviden-tiary hearing counsel for the defendant moved for summary judgment. The motion is hereby overruled as being untimely made pursuant to FED.R.CIV.P. 56.
