Stanford Cutts appeals from an order of the circuit court denying his petition to adopt a four-year-old boy and committing the child permanently to the Oregon State Public Welfare Commission.

During the spring of 1956, Stanford became acquainted with an unmarried woman who expected shortly to bear a child. Stanford was then married to a woman hereafter called Zaree. Stanford and Zaree believed themselves to be without hope of posterity and wanted to obtain a child. They did so without either the expense or the legal safeguards of adoption.
