Appeal from the general term of the Supreme Court, in the second district, where a judgment rendered at special term, in favor of the plaintiffs, upon the report of a referee, had been reversed. This was an action upon a promissory note, dated the 15th March 1841, whereby Jophat Hasbrouck, of whose estate the defendant was administrator, promised to pay to Joseph 0. Hasbrouck, or bearer, the sum of $244.80, on the 1st April 1843, with interest at six per cent, to be paid annually, of which the plaintiffs were the holders. *The complaint stated, in substance, that prior to July 29th, 1845, the…

This action was tried before a referee who reported in favor of the plaintiffs; judgment was entered upon the report, and defendant appealed to the general term of the supreme court. The court then ordered the report of the referee to be set aside and judgment to be rendered for the defendant. From that judgment the plaintiffs have appealed to this court.
