In a proceeding pursuant to CPLR article 78 to review a determination of the appellant New York City Board of Education dated July 21, 1989, made after a hearing, finding the petitioner guilty of various acts of misconduct and recommending that he be dismissed from his position as a tenured teacher, the appeal, by permission, is from a judgment of the Supreme Court, Kings County (Greenstein, J.), dated July 11, 1990, which annulled the determination insofar as it imposed the penalty of dismissal and remitted the matter for the imposition of a lesser penalty.
