* Writ of error refused June 3, 1925. The Tyler Hotel Company is a private corporation organized under the laws of Texas. In September, 1921, it entered into a contract with the Kidd-Scruggs Company, another private corporation, for the construction of a hotel building at Tyler, Tex. By the terms of the construction contract the Kidd-Scruggs Company was to furnish all the labor and material to complete the building for the sum of $226,545. Payment of this amount was to be made as the work progressed, upon estimates furnished by Hill Co., the supervising architects. A margin of 15 per cent.…
