Paul Casale and Anthony Garcia (“named plaintiffs”) assert that Raymond W. Kelly, Police Commissioner of the New York City Police Department (“NYPD”); the City of New York; and unnamed NYPD personnel (collectively “defendants”) have violated and continue to violate their Fourth, Fifth, and Fourteenth Amendment rights and the rights of those similarly situated' — and have falsely arrested and maliciously prosecuted them— by enforcing provisions of New York State’s loitering law declared unconstitutional over twenty years ago.
